1. Scope

These General Terms and Conditions (hereinafter the “Terms”) of con:concept congress GmbH, registered office in Graz, business address Stiftingtalstraße 14 / ZWT II, 8010 Graz, Austria, registered in the companies register of the Regional Court for Civil Matters Graz under FN 627115d (hereinafter the “Organiser”), govern the legal relationship between participants in conferences, seminars, congresses and other events (hereinafter collectively the “Event”) on the one hand and the Organiser on the other.

These Terms become part of the contract with your consent, provided that we can prove that you have actually taken note of and agreed to them. By entering the areas or premises designated by the Organiser for the respective Event, the participant also agrees to be bound by the house rules applicable there, which the participant will familiarise themselves with independently at the venue.

2. Validity of Registration / Hotel Booking

Registration for the Event is generally made via the website of con:concept congress GmbH. If a prospective participant contacts the Organiser by other means, such as e-mail or telephone, the Organiser’s reply shall be deemed an offer, which is always non-binding and subject to change.

The contract is concluded upon payment of the participation fee or upon written booking confirmation.

Hotel reservations must be made by participants themselves.

3. Fees, Terms of Payment and Included Services

All prices are stated in euros and exclude statutory VAT, which will be shown separately on the invoice. Payments must be made in euros.

All invoices issued by the Organiser are due upon receipt and must be paid in full, without deduction, within 10 working days to the bank account communicated to the participant.

The participation fee covers only attendance of the booked part of the Event, unless an additional service is explicitly stated. Separate fees may be charged for additional workshops, continuing education sessions, the social programme, etc.

4. Cancellation

For cancellations made up to 30 days before the Event, a fee of € 50.00 (plus 20% VAT) will be charged.

For later cancellations, 100% of the participation fee will be charged.

Cancellations must be made in writing (letter or e-mail).

Capacity is limited for all Events. In addition, a minimum number of participants may be required. We reserve the right to cancel the Event if the minimum number of participants is not reached. In the event of such a cancellation, any payments already made by the participant will be refunded. This does not give rise to any reimbursement of expenses incurred or any other claims against con:concept congress GmbH.

5. Changes to the Programme and Cancellation of the Event

5.1 Force Majeure

Please note that necessary changes to the Event programme, the speakers and the venue may occur.

If the Event cannot take place as planned due to a force majeure event, the Event may be postponed to another date and/or moved to another location, or cancelled.

A force majeure event is any event that is uncontrollable, unavoidable, cannot be overcome by reasonable means and was not caused by either party. Force majeure events include in particular, but are not limited to:

• riots, armed conflicts and strikes;
• extraordinary natural events such as earthquakes;
• epidemics and pandemics;
• the consequential effects of such events on the demand for the services offered.

If the Event is cancelled as a result of a force majeure event, or if the participant is unable to attend the booked Event on the new date following a postponement, a flat fee of 25% of the agreed fee shall become payable to cover the expenses incurred.

Claims for damages by the participant resulting from the postponement or cancellation of the Event are excluded.

5.2 Other Reasons

If the Event has to be cancelled for other reasons, the participant will be notified immediately at the e-mail address most recently provided. In this case, participation fees already paid will be refunded in full. Any further claims are excluded, unless such claims arise from grossly negligent or intentional conduct on the part of the Organiser.

6. Photo Documentation and Videos

Audio and video recordings of the Event are only permitted with prior special written permission and may not be passed on to third parties.

Videos and photos of the Event taken by the Organiser may be used for future marketing purposes; the participant expressly consents to this.

7. Limitation of Liability

The Organiser is not liable for the loss of or damage to items brought to the Event, unless such claims arise from grossly negligent or intentional conduct on the part of the Organiser.

The Organiser accepts no liability or warranty for the accuracy of statements made by speakers.

The respective event host is solely liable for the provision of the booked services and for any defects in their performance.

Participation in the Event, including all activities and the social programme, is at the participant’s own risk. The Organiser is not liable for damage resulting from accidents.

8. Applicable Law and Place of Jurisdiction

Contracts are governed by the substantive law of the Republic of Austria, excluding its conflict-of-law rules.

For disputes arising from the legal relationship between the participant and the Organiser, the Regional Court for Civil Matters Graz is agreed as the place of jurisdiction, provided that the participant is not a consumer within the meaning of Section 1 of the Austrian Consumer Protection Act (KSchG).

9. Severability Clause

Should any provision of these Terms be or become invalid, in whole or in part, or become invalid due to statutory provisions, the remaining provisions of these Terms shall remain unaffected.

10. Notice

Please note that your contact details will be included in a list of participants and will be passed on.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us,

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within 14 days from the day on which we received notice of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment you used for the initial transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
